Paul Cadman on Fire Risk Assessment

Before entering the private sector i was a serving Fireman with West Midlands Fire Brigade for over 18 years.

I spent the last couple of years as a Training Officer instructing new Firefighters in the latest techniques and passing on my experience.

Based on my time in the Brigade i never underestimate the vital importance of Fire Safety Management. Whilst this was a fantastic career not all of the experiences were by any means pleasant and i will never loose this awareness when carrying out fire risk assessments or training my team here at mhl support.

RIDDOR stands for Reportable Injuries Diseases and Dangerous Occurrence Regulations (1995)
These regulations place full responsibility on employers to report certain events or injuries to the Health and Safety Executive. The confusing thing is knowing what to report and when.

Notifying the Health and Safety Executive (HSE)

If there is an accident connected with you workplace and an employee, self-employed person, or a member of the public are injured, then you may need to contact the HSE to advise them of the situation.

However when you do you are then likely to come under investigation with Inspectors demanding to see your Health and Safety Management System .

They will also want to see that it has been implemented and then will certainly want to talk to your workforce and inspect your workplace.

RIDDOR Reporting :

I have been Operations manager at mhl for the last 2 years. Prior to this i worked for a couple of smaller health and safety companies and spent 18 years in the West Midlands Fire Brigade.

Paul Cadman on care homes

mhl support's ceo recently warned the owners and operators of UK care homes to 'prepare for a backlash' following the appointment of Cynthia Bowers to the role of chief executive of the Care Quality Commission.

This is the new government body that will regulate the NHS and the private care sector after the demise of the Healthcare Commission.

As Head of Health and Safety Operations, Paul Cadman, whose department handles legislative compliance issues for more than 200 care home operators, contests that "many care homes are failing to comply with current legislation".

He is worried that new changes will put many more homes in danger of prosecution and if they fail to keep pace with the new developments.

He stated "it's vital that care home owners act immediately to ensure that they comply to-the-letter with Health and Safety legislation in three fundamental areas of management, these are fire risk assessments, infection control and staff training."

He then went on to say : "Failure to do so will leave both the managers and owners of the home exposed to fines, prosecutions and even custodial sentences; something made ever more likely following the introduction of the H&S Offences (2008) Act in January this year.

Paul Cadman gives thoughts and advice on swine flu.

Many companies could face legal claims from employees hit by swine flu, legal experts have warned. Thousands are falling ill and considering claims against their employers for not adequately protecting them from the risks.

Across the board claims for health and safety failures, and negligence look set to rise amid growing concerns that firms are not ready to deal with swine flu-related issues.

Employees in general are becoming increasingly litigation aware, with employment tribunal claims up 4% last year. Lawyers said that staff who believe they have contracted swine flu at work may sue if they can show that their employer failed to take enough precautions.

A recent quote in the Guardian said : "If employers don't take some steps to consider what will happen if someone is affected, there are myriad health and safety and duty of care regulations that would come into play."

This could prove to be extremely expensive both in settlements and of course the follow on of increased premiums.

Any company will need to show they have take all steps necessary to ensure the health and safety of their employees as if one swine flu claim is successful this could open the floodgates to claims from an entire workforce.

This is not something you can leave on the back burner and hope it will be OK. Swine Flu is a reality that must be considered now as leaving it uncovered is not an option any responsible employer can risk.

Corporate Manslaughter Advice from Paul Cadman.

The Corporate Manslaughter and Corporate Homicide Act 2007 came into force on April the 6th 2008. This affects anyone who is responsible for employee and public safet under the health and safety at work act.

You now have also responsibility as an employer under the Corporate manslaughter act.

You are at risk of prosecution under the Act if you breach your statutory Health and Safety duties and an employee or member of the public dies as a result.

A jury can decide if the breach was sufficiently serious and posed a sufficient risk of death. If found guilty the company or organisation will be convicted.

You need to be confident that your Health and Safety Management systems are both up to date and safe working practices are being followed by all your employees and visitors.

In the event of a fatality to either a member of staff or the general public you must prove that you have implemented safe working practices and procedures and that you have made all your employees aware of this.

If not you could be liable and may face prosecution.
