Many companies could face legal claims from employees hit by swine flu, legal experts have warned. Thousands are falling ill and considering claims against their employers for not adequately protecting them from the risks.

Across the board claims for health and safety failures, and negligence look set to rise amid growing concerns that firms are not ready to deal with swine flu-related issues.

Employees in general are becoming increasingly litigation aware, with employment tribunal claims up 4% last year. Lawyers said that staff who believe they have contracted swine flu at work may sue if they can show that their employer failed to take enough precautions.

A recent quote in the Guardian said : "If employers don't take some steps to consider what will happen if someone is affected, there are myriad health and safety and duty of care regulations that would come into play."

This could prove to be extremely expensive both in settlements and of course the follow on of increased premiums.

Any company will need to show they have take all steps necessary to ensure the health and safety of their employees as if one swine flu claim is successful this could open the floodgates to claims from an entire workforce.

This is not something you can leave on the back burner and hope it will be OK. Swine Flu is a reality that must be considered now as leaving it uncovered is not an option any responsible employer can risk.
