Corporate Manslaughter Advice from Paul Cadman.

The Corporate Manslaughter and Corporate Homicide Act 2007 came into force on April the 6th 2008. This affects anyone who is responsible for employee and public safet under the health and safety at work act.

You now have also responsibility as an employer under the Corporate manslaughter act.

You are at risk of prosecution under the Act if you breach your statutory Health and Safety duties and an employee or member of the public dies as a result.

A jury can decide if the breach was sufficiently serious and posed a sufficient risk of death. If found guilty the company or organisation will be convicted.

You need to be confident that your Health and Safety Management systems are both up to date and safe working practices are being followed by all your employees and visitors.

In the event of a fatality to either a member of staff or the general public you must prove that you have implemented safe working practices and procedures and that you have made all your employees aware of this.

If not you could be liable and may face prosecution.
